Preamble

Welcome to RISING ATELIER™. These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and the purchase of our products. By visiting our site or placing an order, you agree to be bound by these Terms.

RISING ATELIER™ operates as a limited-production, allocation-only garment house. All products are offered subject to availability and acceptance of your order. We reserve the right to refuse or cancel an order at our discretion, including in cases of suspected fraud, abuse of policies, or where required to comply with applicable laws.

Nothing in these Terms limits rights granted to consumers under applicable laws, including the Consumer Protection Act (Québec) and PIPEDA.

1. General Conditions

RISING ATELIER™ garments are produced in limited quantities (221 units per release) and offered through allocation-only pre-orders. Production begins after the order window closes.

We conduct business in accordance with:

• The Consumer Protection Act (Québec)
• The Personal Information Protection and Electronic Documents Act (PIPEDA)
• Quebec's Charter of the French Language (Bill 96)

French Language Requirement: In accordance with Quebec law, all consumer-facing materials are provided in French and English, with French presented in at least equivalent conditions.

2. Products & Availability

All descriptions, images, and specifications are provided for informational purposes. Estimated production and delivery timelines are clearly stated at checkout.

3. Pricing & Payments

• All prices displayed in CAD at checkout
• A 50% deposit is required to secure your pre-order, with the remaining balance due prior to shipment
• Secure third-party payment processing
• Customer confirms authorization to use payment method and accuracy of billing information

4. Pre-Orders & Allocation

Key Requirements: Pre-order status does not limit statutory consumer rights under applicable law.

5. Shipping & Delivery

• Customer responsible for accurate shipping information
• Delivery to carrier constitutes fulfillment of our obligation
• Carrier delays/losses governed by carrier terms
• International orders subject to customs duties (customer responsibility)

6. Intellectual Property

All content, designs, logos, and branding elements are exclusive property of Unbroken Rising Holdings Inc. No reproduction without written permission.

7. Limitation of Liability

To the extent permitted by law, liability limited to amount paid for product giving rise to claim. Nothing excludes liability where prohibited by law.

8. Governing Law

These Terms governed by laws of Province of Québec and federal laws of Canada.
